On 14th December 2024, Law 7/2024 of 11 December, on urgent measures for the administrative simplification and rationalisation of public authorities within the Balearic Islands was approved, including the procedure for the exceptional legalisation of existing buildings, structures, facilities and utilities on rural land.
This Act covers the legalisation – exceptionally and within a maximum deadline of 3 years – of buildings on rural land without generally applicable urban planning conditions and parameters being enforced. This legalisation concedes the same rights and obligations as structures built with planning permission, but precludes applying for a tourist license, what’s more, any resolution permitting the exceptional legalisation of a house must expressly state that its use as tourist accommodation is strictly forbidden.
The interested party must apply to the Town Council, requesting an exceptional legalisation permit, accompanied by a technical legalisation project.
Only those buildings, structures, installations and utilities already existing on rural land for which, at the time the application is submitted, it is no longer necessary to adopt measures to restore urban legality may be legalised. Those which might be considered to have breached urban planning laws because work has been carried out without the required permit, and whose infringement has not expired, will not be legalised.
